Legal Lifeline Services

To help you manage disputes members have telephone access to free advice. Employment law is a minefield - following a disciplinary procedure, controlling absence, queries on maternity/paternity. A panel of legal advisors are on hand to help with employment related queries 24 hours a day 365 days a year.

A team of advisors are also available to assist with queries on Commercial Law, Health and Safety, Tax and Payroll – this service is available between 9am and 5pm Monday to Friday on normal working days throughout the year.

Legal Expenses Insurance

In the commercial world of today, legal actions are ever increasing, causing inconvenience to businesses in both terms of time and cost. All members are automatically registered to a Commercial Legal Expenses Scheme. The policy will pay legal costs up to £50,000 including solicitors’ and barristers’ fees, court costs, expenses for expert witness and accountants’ fees subject to normal policy terms, conditions and limitations being met. The policy may also pay the costs of appealing or defending an appeal.

In all instances the first £250 of costs and expenses in respect of any claim must be paid by you direct to the representative appointed to act for you as soon as a claim is accepted.

Restrictive Covenants

For law courts to consider a restrictive covenant to be reasonable, it should not normally exceed a ½ mile radius of the employee’s place of work or cover a period of more than six months. The legal helpline will give clear advice, and if needed, template letters for you to send to your ex-employee.  If this doesn’t work, for a fixed fee of £250 (plus VAT), you can instruct one of our nominated solicitors to send a more strongly worded letter and request an assessment about how strong your case is and the chances of getting an injunction.

Support is offered even if you don’t use the NHF contracts, as long as there is a clear restrictive covenant within the contract.

Supporting You in Tax Matters

The Legal Lifeline and insurance service offers confidential advice on tax and VAT matters from Monday to Friday 9am - 5pm. It provides for payment of up to £50,000 per case for accountancy and legal fees incurred from all tax and VAT investigations as well as PAYE assessments and P11D compliance investigations. Claims must be lodged within six months of the insurable event occurring. All tax and VAT claims are subject to a £250 excess fee. Full details of cover and exclusions are availible from Head Office on request.

Fair Usage

The NHF operate a Fair Use Policy in respect of the legal lifeline. Members exceeding 50 calls to the Lifeline within a twelve month period may be charged £20 plus VAT per call.

All Calls to the legal lifeline are recorded and monitored by Ellis Whittam, our lifeline providers. If your chosen membership catagory does not include the employer support service OR your membership is unpaid at the time of any call, a charge of £20 plus VAT will apply for all such calls made.
